August 5, 2010 - On August 5, 2010, the Illinois Pollution Control Board granted a motion by the Metropolitan Water Reclamation District of Greater Chicago to held additional hearings in In the Matter of: Water Quality Standards and Effluent Limitations for the Chicago Area Waterway System and Lower Des Plaines River Proposed Amendments to 35 Ill. Adm. Code 301, 302, 303, and 304 (R08-09 (Subdocket B)). The Illinois Environmental Protection Agency (IEPA) filed the original proposal on October 26, 2007. On March 18, 2010, the Board divided the docket into four subdockets.

September 2, 2010 - On September 2, 2010, the Board accepted for hearing a proposal for amendments to the Board’s air rules. The Illinois Environmental Protection Agency (IEPA), on August 19, 2010, filed the proposal that was docketed as In the Matter of: NOx Trading Program Sunset Provisions for Non-Electric Generating Units: Amendments to 35 Ill. Adm. Code Party 217.Subpart U (R11-08).

October 21, 2010 - On October 21, 2010, the Pollution Control Board adopted definitions relating to used oil management in the rulemaking docket designated In the Matter of: Proposed Amendments to the Board’s Special Waste Regulations Concerning Used Oil, 35 Ill. Adm. Code 739, 808, 809 (R06-20(B)). The Board adopted one definition in its used oil management standards and three definitions in its special waste regulations.

February 18, 2010 - On February 18, 2010, the Illinois Pollution Control Board adopted a final order amending its special waste regulations and corresponding used oil management provisions. The amendments are intended to exempt from the manifesting requirements of Parts 808 and 809 both used oil defined by and managed in accordance with Part 739 and specific mixtures of used oil and other materials.

March 18, 2010 - On March 18, 2010, the Illinois Pollution Control Board adopted a final order in the rulemaking proposal docketed as In the Matter of: Reasonably Available Control Technology (RACT) for Volatile Organic Material Emission From Group III Consumer & Commercial Products: Proposed Amendments to 35 Ill. Adm. Code 218 and 219 (R10-10).

September 2, 2010 - On September 2, 2010, the Illinois Pollution Control Board adopted its final order in the rulemaking proposal docketed as In the Matter of: Reasonably Available Control Technology (RACT) for Volatile Organic Material Emission From Group IV Consumer & Commercial Products: Proposed Amendments to 35 Ill. Adm. Code 211, 218, and 219 (R10-20). On March 8, 2010, the Illinois Environmental Protection (IEPA) filed the proposal pursuant to the “fast-track” rulemaking provisions at Section 28.5 of the Environmental Protection Act (Act).

December 2, 2010 - On December 2, 2010, the Board adopted final notice amendments to the Board’s procedural rules updating the proper mailing address for the Division for Chief of Environmental Enforcement at the Office of the Attorney General, and the Office of Legal Services at the Illinois Department of Natural Resources. The Illinois Attorney General’s Office (AG), on June 2, 2010, filed the proposal which is docketed as In the Matter of: Revision of Mailing Address for Service of Documents Proposed Amendments to 35 Il. Adm. Code 101-304 (R10-22).

June 17, 2010 - On June 17, 2010, the Illinois Pollution Control Board adopted a final order adopting air pollution regulations. The Illinois Environmental Protection Agency initiated this proceeding on July 9, 2009, and the Board has docketed it as In the Matter of: Reasonably Available Control Technology (RACT) for Volatile Organic Material Emissions from Group II Consumer & Commercial Products: Proposed Amendments to 35 Ill. Adm. Code 211, 218, and 219 (R10-08).

January 7, 2010 - The Pollution Control Board, on January 7, 2010, adopted the rulemaking docketed as In the Matter of: Definition of VOM Update, USEPA Regulations (January 1, 2009 through June 30, 2009) (R10-7), which adds two compounds to the list of those exempted from the definition of Volatile Organic Material (VOM). The update is needed to ensure that Illinois’ regulations reflect the United States Environmental Protection Agency’s (USEPA) most recent exemption of chemical compounds from regulation as ozone precursors.

August 19, 2010 - On August 19, 2010, the Illinois Pollution Control Board adopted for first-notice a proposal docketed as In the Matter of: Reasonably Available Control Technology (RACT) for volatile Organic Material Emissions From Group II consumer & Commercial Products: Propose Amendments to 35 Ill. Adm. Code 211, 218, and 219, R10-08(A). The Board took this action without commenting on the merits of the proposal. The Illinois Environmental Protection Agency (IEPA) indicates that recently adopted rules contain a technical error and that it seeks a mechanism to correct it.

Adm. Code 211, 218, and 219 (R10-20). This rulemaking was filed on March 8, 2010 by the Illinois Environmental Protection (IEPA) pursuant to the “fast-track” rulemaking provisions at Section 28.5 of the Environmental Protection Act (Act).

November 4, 2010 - On November 4, 2010, the Board adopted for first notice a proposal to amend Part 243 of the Board’s air regulations to incorporate updated federal air quality standards for ozone, particulate matter, and lead. The Illinois Environmental Protection Agency (IEPA) filed the proposal on December 1, 2008. After conducting two public hearings in this matter and considering the entire record, the Board proposed for first notice the amendments to its air quality standards.

January 21, 2010 - The Board, on January 21, 2010, proposed for first notice rules that would allow videoconference hearings in rulemaking proceedings pursuant to Section 7.2 of the Environmental Protection Act (Act) (415 ILCS 5/7.2 (2008)). The proposal is docketed as In the Matter of: Proposed Amendment to Procedural Rules on Hearings in Identical in Substances Rulemakings (R10-18).

September 2, 2010 - On September 2, 2010, the Pollution Control Board adopted for second notice review proposed definition relating to used oil management in the rulemaking docket designated In the Matter of: Proposed Amendments to the Board’s Special Waste Regulations Concerning Used Oil, 35 Ill. Adm. Code 739, 808, 809 (R06-20(B)). In an order dated February 18, 2010, the Board adopted amendments to its used oil management and special waste regulations in the docket now designated as subdocket A.

February 5, 2010 - On February 5, 2010, the Illinois Pollution Control Board adopted for second notice the rulemaking proposal docketed as In the Matter of: Reasonably Available Control Technology (RACT) for Volatile Organic Material Emission From Group III Consumer & Commercial Products: Proposed Amendments to 35 Ill. Adm. Code 281 and 219 (R10-10). The second notice proposal includes changes reflected in the IEPA’s motion to amend, which the Board granted in its second-notice opinion and order.

On March 8, 2010, the Illinois Environmental Protection (IEPA) filed the proposal pursuant to the “fast-track” rulemaking provisions at Section 28.5 of the Environmental Protection Act (Act).

July 15, 2010 - On July 15, 2010, the Illinois Pollution Control Board adopted final rules in its opinion and order in In the Matter of: Procedural Rules for Authorizations Under P.A. 95-115 (Regulation of Phosphorus in Detergents Act): New 35 Ill. Adm. Code 106.Subpart H, (R10-19). The Joint Committee on Administrative Rules voted a “certificate of no objection” to the rules at its July 13, 2010 meeting.

November 4, 2010 - On November 4, 2010, the Illinois Pollution Control Board adopted for second-notice a proposal to amend its air regulations addressing emission of volatile organic material (VOM). The rulemaking is docketed as In the Matter of: Reasonably Available Control Technology (RACT) for volatile Organic Material Emissions From Group II consumer & Commercial Products: Propose Amendments to 35 Ill. Adm. Code 211, 218, and 219, R10-08(A). This proposal stems from an Illinois Environmental Protection Agency (IEPA) motion seeking to correct a technical error in recently-adopted rules. The rulemaking proposal will now be reviewed by the Joint Committee on Administrative Rules (JCAR).
