August 5, 2010 - On August 5, 2010, the Illinois Pollution Control Board granted a motion by the Metropolitan Water Reclamation District of Greater Chicago to held additional hearings in In the Matter of: Water Quality Standards and Effluent Limitations for the Chicago Area Waterway System and Lower Des Plaines River Proposed Amendments to 35 Ill. Adm. Code 301, 302, 303, and 304 (R08-09 (Subdocket B)). The Illinois Environmental Protection Agency (IEPA) filed the original proposal on October 26, 2007. On March 18, 2010, the Board divided the docket into four subdockets.

Adm. Code 739, 808, 809 (R06-20(B)). The Board adopted one definition in its used oil management standards and three definitions in its special waste regulations.

The amendments are intended to exempt from the manifesting requirements of Parts 808 and 809 both used oil defined by and managed in accordance with Part 739 and specific mixtures of used oil and other materials.

The Illinois Environmental Protection Agency initiated this proceeding on July 9, 2009, and the Board has docketed it as In the Matter of: Reasonably Available Control Technology (RACT) for Volatile Organic Material Emissions from Group II Consumer & Commercial Products: Proposed Amendments to 35 Ill. Adm. Code 211, 218, and 219 (R10-08).

January 7, 2010 - The Pollution Control Board, on January 7, 2010, adopted the rulemaking docketed as In the Matter of: Definition of VOM Update, USEPA Regulations (January 1, 2009 through June 30, 2009) (R10-7), which adds two compounds to the list of those exempted from the definition of Volatile Organic Material (VOM). The update is needed to ensure that Illinois’ regulations reflect the United States Environmental Protection Agency’s (USEPA) most recent exemption of chemical compounds from regulation as ozone precursors.

The Illinois Environmental Protection Agency (IEPA) indicates that recently adopted rules contain a technical error and that it seeks a mechanism to correct it.

November 4, 2010 - On November 4, 2010, the Board adopted for first notice a proposal to amend Part 243 of the Board’s air regulations to incorporate updated federal air quality standards for ozone, particulate matter, and lead. The Illinois Environmental Protection Agency (IEPA) filed the proposal on December 1, 2008. After conducting two public hearings in this matter and considering the entire record, the Board proposed for first notice the amendments to its air quality standards.

July 15, 2010 - On July 15, 2010, the Illinois Pollution Control Board adopted final rules in its opinion and order in In the Matter of: Procedural Rules for Authorizations Under P.A. 95-115 (Regulation of Phosphorus in Detergents Act): New 35 Ill. Adm. Code 106.Subpart H, (R10-19). The Joint Committee on Administrative Rules voted a “certificate of no objection” to the rules at its July 13, 2010 meeting.

Adm. Code 211, 218, and 219, R10-08(A). This proposal stems from an Illinois Environmental Protection Agency (IEPA) motion seeking to correct a technical error in recently-adopted rules. The rulemaking proposal will now be reviewed by the Joint Committee on Administrative Rules (JCAR).
