June 21, 2012 - On June 21, 2012, the Board adopted a maximum setback zone for six community water supply (CWS) wells owned by Fayette Water Company in Fayette County. The wells serve portions of Fayette, Shelby, and Kaskaskia Counties. The proposal was filed by the Illinois Environmental Protection Agency (IEPA) on April 21, 2011, and is docketed as In the Matter of: Setback Zone for Fayette Water Company Community Water Supply: Amendments to 35 Ill. May 3, 2012 - On May 3, 2012, the Illinois Pollution Control Board adopted amendments to Part 223 of the Board’s regulations addressing volatile organic material (VOM) emissions from various consumer products and aerosol coatings. On July 13, 2011, the Illinois Environmental Protection Agency (IEPA) filed the proposal, which is docketed as In the Matter of: Standards and Limitations for Organic Material Emissions for Area Sources: Amendments to 35 Ill. Adm. Code Part 223, (R12-8).

  Document Board Adopts Amendments to the Enhanced Vehicle Emission Inspection and Maintenance (I/M) Regulations

January 5, 2012 - On January 5, 2012, the Board adopted amendments that sunset the steady-state idle and evaporative system integrity test standards used in the Illinois enhanced vehicle inspection and maintenance program for the Chicago and Metro-East St. Louis nonattainment areas. The Illinois Environmental Protection Agency (IEPA), on October 3, 2011, filed the proposed rulemaking which was docketed as In the Matter of: Revision of Enhanced Vehicle Emission Inspection and Maintenance (I/M) Regulations: Amendments to 35 Ill. Adm. Code Part 240 (R12-12).

July 12, 2012 - On July 12, 2012, the Board adopted amendments to the Board’s solid waste and special waste hauling regulations. On October 28, 2011, the Illinois Environmental Protection Agency (IEPA) filed the proposal, which was docketed as In the Matter of: Proposed Amendments to Nonhazardous Special Waste Hauling and the Uniform Program: (35 Ill. Adm. Code 809), (R12-13).

  Document Board Adopts an Effluent Limit for Primary Contact Recreation Use Waters

February 2, 2012 - The Illinois Pollution Control Board, on February 2, 2012, adopted a rule establishing an effluent limit for fecal coliform colony forming units (CFU) during the period of March 1 through November 30 for effluent discharges to Primary Contact Recreation water segments of the Chicago Area Waterway System (CAWS) and Lower Des Plaines River (LDPR). Code 620), (R08-18), was initiated by the Illinois Environmental Protection Agency (IEPA) to amend Part 620 of Title 35 of the Illinois Administrative Code (35 Ill. Adm. Code 620).

  Document Board Adopts First Notice Opinion and Order in Proposed Rulemaking for Amendments for Clean Construction or Demolition Debris Fill Operations Rules

February 2, 2012 - The Illinois Pollution Control Board, on February 2, 2012, adopted a first notice opinion and order in a proposal to amend the Board’s rules for Clean Construction or Demolition Debris and Uncontaminated Soil Fill Operations to allow for use of uncontaminated clean construction or demolition debris (CCDD) and uncontaminated soil to be used as fill at quarries, mines and other excavations. On July 29, 2011, the Illinois Environmental Protection Agency (IEPA) filed the proposal with the Board, which was docketed as Proposed Amendments To Clean Construction Or Demolition Debris Fill Operations (CCDD): Proposed Amendments To 35 Ill. Adm. Code 1100, R12-9. The Board must adopt the rule no later than one year after receipt of the IEPA’s proposal.

September 20, 2012 - On September 20, 2012, the Pollution Control Board proposed amendments to its solid waste and special waste hauling regulations for first-notice publication in the Illinois Register without commenting on the substantive merits.   Document Board Adopts First-Notice Opinion and Order for Proposal Concerning Illinois’ Rules for Gasoline Volatility

April 19, 2012 - The Board, on April 19, 2012, adopted a first-notice opinion and order in response to a proposal to repeal state gasoline volatility standards, codified at 35 Ill. Adm. Code 215.585 and 219.585, since these have been replaced by federal standards. The rulemaking proposal filed on April 2, 2012, by the Illinois Environmental Protection Agency (IEPA) is docketed as In the Matter of: Gasoline Volatility Standards and Motor Vehicle Refinishing, Proposed amendments to 35 Ill. Adm. Code Parts 211, 215, 218, and 219, (R12-24).

  Document Board Adopts for New Procedural Rules for Landscape Waste and Compost Authorizations Under 415 ILCS 21(q), R 12-11

November 1, 2012 - On November 1, 2012, the Board adopted new procedural rules for adjusted standards addressing Board authorizations for certain landscape waste and compost applications and on-farm composting. The rulemaking is docketed as In the Matter Of: Procedural Rules for Authorizations Under P.A. 97-220 For Certain Landscape Waste and Compost Applications and On-Farm Composting Facilities: New 35 Ill. Adm. Code 106.Subpart I, R12-11. The procedural rules are in response to P.A. 97-220, signed and effective July 28, 2011. P.A. 97-220 amended the Environmental Protection Act to specify that the Board rather than the IEPA may authorize certain exceptions to the provisions of Section 21(q) of the Environmental Protection Act (Act), 415 ILCS 5/21. The rules are effective upon filing with the Secretary of State.

Given the type of changes being proposed in response to public comments received during the first notice period, the Board found it advisable to again publish first notice changes in the Illinois Register and to initiate another public comment period.
