August 18, 2011 - On August 18, 2011, the Board accepted for hearing a proposal by the Illinois Environmental Protection Agency (IEPA) to create a program for Registration of Smaller Sources (ROSS). The Board directed the Clerk to publish the proposal, docketed as In the Matter of: Registration of Smaller Sources (ROSS): New 35 Ill. Adm. Code 201.175 (R12-10), in the Illinois Register for public comment.

October 6, 2011 - On October 6, 2011, the Board accepted for hearing a proposal that would sunset the steady-state idle and evaporative system integrity test standards used in the Illinois enhanced vehicle inspection and maintenance program for the Chicago and Metro-East St. Louis nonattainment areas. The Illinois Environmental Protection Agency (IEPA), on October 3, 2011, filed the proposed rulemaking which was docketed as In the Matter of: Revision of Enhanced Vehicle Emission Inspection and Maintenance (I/M) Regulations: Amendments to 35 Ill. Adm. Code Part 240 (R12-12).

December 1, 2011 - On December 1, 2011, the Board adopted amendments to Part 201 of its air pollution regulations, which address permits and general provisions. Specifically, the Board adopted a new Section 201.175 implementing Registration of Smaller Sources (ROSS). The amendments will become final upon filing with the Secretary of State.

October 20, 2011 - On October 20, 2011, the Illinois Pollution Control Board adopted amendments to its air pollution regulations addressing emission of volatile organic material (VOM). The rulemaking is docketed as In the Matter of: Reasonably Available Control Technology (RACT) for Volatile Organic Material Emissions From Group II and Group IV Consumer & Commercial Products: Proposed Amendments to 35 Ill. Adm. Code 218.208 and 219.208, (R11-23(A)).

September 22, 2011 - On September 22, 2011, the Board adopted amendments to the Board’s air rules. The Illinois Environmental Protection Agency (IEPA), on August 19, 2010, filed the proposal that was docketed as In the Matter of: NOx Trading Program Sunset Provisions for Non-Electric Generating Units: Amendments to 35 Ill. Adm. Code Party 217.Subpart U (R11-08).

July 21, 2011 - On July 21, 2011, the Illinois Pollution Control Board adopted amendments to its air pollution regulations governing emissions of volatile organic material (VOM). The rulemaking is docketed as In the Matter of: Reasonably Available Control Technology (RACT) for Volatile Organic Material Emissions From Group II and Group IV Consumer & Commercial Products: Proposed Amendments to 35 Ill. Adm. Code 211, 218, and 219 (R11-23). The Illinois Environmental Protection (IEPA) filed this rulemaking on March 7, 2011 pursuant to authorities including the “fast-track” rulemaking provisions at Section 28.5 of the Environmental Protection Act (Act).

June 16, 2011 - The Board, on June 16, 2011, adopted final amendments to its waste disposal regulations in Parts 807, 810 and 811. The Illinois Environmental Protection Agency (IEPA) filed the rulemaking proposal on July 27, 2009 that is docketed as In the Matter of: Financial Assurance Instruments – Renewal and Terms: Amendments to 35 Ill. Adm. Code 807.Subpart F and Appendix A, 810.104, 811.Subparts C, G and Appendix A (R10-09).

July 7, 2011 - The Illinois Pollution Control Board, on July 7, 2011, adopted a first-notice opinion and order in the rulemaking docketed as In the Matter of: Water Quality Standards and Effluent Limitations for the Chicago Area Waterway System (CAWS) and the Lower Des Plaines River: Proposed Amendments to 35 Ill. Adm. Code 301, 302, 303 and 304 (R08-09B).

October 20, 2011 - The Illinois Pollution Control Board, on October 20, 2011, adopted for first notice a proposal to amend the Board’s groundwater quality rules. This rulemaking, docketed as Proposed Amendments to Groundwater Quality Standards, 35 Ill. Adm. Code 620, (R08-18), was initiated by the Illinois Environmental Protection Agency (IEPA) to amend Part 620 of Title 35 of the Illinois Administrative Code (35 Ill. Adm. Code 620).

October 20, 2011 - On October 20, 2011, the Board proposed for first notice publication in the Illinois Register new procedural rules for adjusted standards addressing Board authorizations for certain landscape waste and compost applications and on-farm composting. In the Matter Of: Procedural Rules for Authorizations Under P.A. 97-220 For Certain Landscape Waste and Compost Applications and On-Farm Composting Facilities: New 35 Ill. Adm. Code 106.Subpart I, R12-11 (Oct. 20, 2011).

February 3, 2011 - The Board, on February 3, 2011, adopted its first notice opinion and order in a proposal to amend its waste disposal regulations. May 19, 2011 - On May 19, the Board adopted for first-notice publication in the Illinois Register a proposal amending the Board’s air rules. The Illinois Environmental Protection Agency (IEPA), on August 19, 2010, filed the proposal that was docketed as In the Matter of: NOx Trading Program Sunset Provisions for Non-Electric Generating Units: Amendments to 35 Ill. June 16, 2011 - On June 16, 2011, the Illinois Pollution Control Board proposed for second-notice review by the Joint Committee on Administrative Rules (JCAR) amendments to its air pollution regulations governing volatile organic material emissions (VOM). The rulemaking proposal is docketed as In the Matter of: Reasonably Available Control Technology (RACT) for Volatile Organic Material Emissions From Group II and Group IV Consumer & Commercial Products: Proposed Amendments to 35 Ill. Adm. Code 211, 218, and 219 (R11-23). The proposed rulemaking would amend recently-promulgated regulations controlling the emission of VOM from a number of categories of consumer and commercial products. The IEPA proposed the amendments to these regulations in response to comments by the United States Environmental Protection Agency.

December 15, 2011 - The Illinois Pollution Control Board, on December 15, 2011, adopted a second-notice opinion and order for a rule establishing an effluent limit for fecal coliform colony forming (CFU) for effluent discharges to Primary contact Recreation water segments of the Chicago Area Waterway System (CAWS) and Lower Des Plaines River (LDPR). The rulemaking is docketed as In the Matter of: Water Quality Standards and Effluent Limitations for the Chicago Area Waterway System (CAWS) and the Lower Des Plaines River: Proposed Amendments to 35 Ill. Adm. Code 301, 302, 303 and 304 (R08-09B).

September 8, 2011 - The Board, on September 8, 2011, adopted for second-notice additional amendments to its waste disposal regulations in a rulemaking docketed as In the Matter of: Financial Assurance Instruments – Renewal and Terms: Amendments to 35 Ill. Adm. Code 807.Subpart F and Appendix A, 810.104, 811.Subparts C, G and Appendix A (R10-09A). The Illinois Environmental Protection Agency (IEPA) wanted the Board to update the rules to correspond with the hazardous waste financial assurance standards derived from the federal Resource Conservation and Recovery Act (RCRA) Subtitle C (42 U.S.C. 6921 et seq. (2007)) hazardous waste regulations and the Board’s other financial assurance programs.

April 21, 2011 - The Board, on April 21, 2011, adopted its second notice opinion and order in a proposal to amend its waste disposal regulations in Parts 807, 810 and 811. The Illinois Environmental Protection Agency (IEPA) filed the rulemaking proposal on July 27, 2009 that is docketed as In the Matter of: Financial Assurance Instruments – Renewal and Terms: Amendments to 35 Ill. Adm. Code 807.Subpart F and Appendix A, 810.104, 811.Subparts C, G and Appendix A (R10-09).

September 22, 2011 - On September 22, 2011, the Board adopted a second-notice opinion and order in R9-19, In the Matter of: Air Quality Standards Clean-Up: Amendments to 35 Ill. Adm. Code Part 243. The proposal would amend Part 243 of the Board’s regulations to reflect updated federal air quality standards for ozone, particulate matter, and lead. The proposal also includes technical corrections to Parts 217 and 223. The Illinois Environmental Protection Agency filed the original rulemaking proposal on December 1, 2008.
