June 21, 2007 - The Illinois Pollution Control Board, on June 21, 2007, accepted for hearing a proposal that seeks to refine when an unpermitted release of radionuclides must be reported to the Illinois Environmental Protection Agency (IEPA). The proposed rulemaking is docketed as Procedures Required by PA 94-849 For Reporting Releases of Radionuclides at Nuclear Power Plants: New 35 Ill. Adm. Code 1010 R07-20).

  Document Board Adopts Amendments to Non-Hazardous Solid Waste Rules

November 15, 2007 - The Illinois Pollution Control Board, on November 15, 2007, adopted for final-notice a proposal to amend Parts 810 and 811 of the Board’s regulations governing solid waste disposal and standards for new solid waste landfills. The Illinois Chapter of the National Solid Wastes Management Association (NSWMA) filed the proposal (Proposed Amendments to Solid Waste Landfill Rules, 35 Ill. Adm. Code 810 and 811 (R07-08)) with the Board on July 27, 2006.

  Document Board Adopts Final Notice Amendments to Volatile Organic Material Rules

April 19, 2007 - The Illinois Pollution Control Board, on April 19, 2007, sent to final notice a proposal amending the volatile organic material (VOM) rules for the Chicago and Metro-East ozone nonattainment areas. The amendments allow for the use of add-on controls as a compliance option for operations using cold cleaning solvent degreasing. The Illinois Environmental Protection Agency filed the rulemaking proposal entitled In the Matter of: Organic Material Emission Standards and Limitations for the Chicago and Metro-East Areas: Proposed Amendments to 35 Ill. Code 218 and 219 (R06-21) on December 22, 2005. Also included, are amendments to the “paper coating” note at Appendix H in Parts 218 and 219.

  Document Board Adopts Final Notice to Amend TACO Rules Used in Site Remediation Projects

February 15, 2007 - On February 15, 2007, the Illinois Pollution Control Board adopted final amendments to the Tiered Approach to Corrective Action Objectives (TACO). TACO is set forth in Part 742 of Title 35 of the Illinois Administrative Code (35 Ill. Adm. Code 742). The Illinois Environmental Protection Agency, on September 30, 2005, initiated this rulemaking by filing proposed amendments to the TACO rules. The rulemaking is docketed as In the Matter of: Proposed Amendments to Tiered Approach to Corrective Action Objectives (35 Ill. Adm. Code 742), R06-10.

September 20, 2007 - The Illinois Pollution Control Board, on September 20, 2007, adopted for final notice the proposal, docketed as In the Matter of: Fast-Track Rules Under Nitrogen Oxide (NOx) SIP Call Phase II: Amendments to 35 Ill. Adm. Code Section 201.146 and Parts 211 and 217 (R07-18). The proposal establishes regulations for the control of nitrogen oxides (NOx) emissions from stationary internal combustion engines affected by the NOx State Implementation Plan (SIP) Call Phase II. The rules intend to reduce interstate and intrastate transport of NOx emissions on ozone season and annual bases by reducing NOx emissions from reciprocating internal combustion engines addressed in the NOx SIP Call Phase II.

July 26, 2007 - The Illinois Pollution Control Board, on July 26, 2007, sent to final notice a proposal to reduce intrastate and interstate transport of sulfur dioxide (SO2) and nitrogen oxides (NOx) emissions from fossil fuel-fired electric generating units. The Illinois Environmental Protection Agency (IEPA), on May 30, 2006, initiated this rulemaking proceeding by filing its proposed rule amendments, docketed by the Board as In the Matter of: Proposed New Clean Air Interstate Rules (CAIR) SO2, NOx Annual and NOx Ozone Season Trading Programs, 35 Ill. Adm. Code 225, Control of Emissions From Large Combustion Sources, Subparts A, C, D, E, and F (R06-26). After five days of hearings and numerous public comments, the Board, on April 19, 2007, proposed amendments for first notice.

August 23, 2007 - The Illinois Pollution Control Board, on August 23, 2007, adopted, as final rules, amendments to reduce intrastate and interstate transport of sulfur dioxide (SO2) and nitrogen oxides (NOx) emissions from fossil fuel-fired electric generating units. The rule amendments, known as the Clean Air Interstate Rule (CAIR), become effective on August 31, 2007.

  Document Board Divides a Proposal to Reduce Transport of Nitrogen Oxide Emissions

May 17, 2007 - On May 17, 2007, the Illinois Pollution Control Board divided an Illinois Environmental Protection Agency (IEPA) rulemaking proposal (R07-18) into two rulemaking dockets. One docket will be an expedited, statutory fast-track rulemaking intended to satisfy Illinois’ obligations under the United States Environmental Protection Agency’s nitrogen oxides (NOx) State Implementation Plan (SIP) Call Phase II. The other rulemaking docket will be a general rulemaking encompassing the other elements of the original proposal.

April 19, 2007 - During its April 19, 2007 meeting, the Illinois Pollution Control Board accepted for hearing without commenting on the merits and sent to first notice a proposal from the Illinois Environmental Protection Agency (IEPA) that is intended to satisfy Illinois’ obligations under the United States Environmental Protection Agency’s nitrogen oxides (NOx) State Implementation Plan (SIP) Call Phase II. On April 6, 2007, the Board accepted IEPA’s proposal, which is docketed as NOx Emissions From Stationary Reciprocating Internal Combustion Engines and Turbines: Amendments to 35 Ill. Adm. Code Section 201.146 and Parts 211 and 217 (R07-18), pursuant to Section 28.5 of the Illinois Environmental Protection Act (Act). Section 28.5 of the Act requires the Board to proceed toward the adoption of the proposed regulation by meeting a series of strict deadlines.

Code 406.203 and Part 407; and Proposed New 35 Ill. Adm. Code 302.208(h) (R07-9).

July 12, 2007 - The Illinois Pollution Control Board, on July 12, 2007, adopted for first notice proposed amendments to Illinois’ general use water quality standards for dissolved oxygen (DO) (35 Ill. Adm. Code 302.206). The Board’s first-notice amendments are based on aspects of both the proposal filed by the Illinois Association of Wastewater Agencies and the joint proposal filed by the Illinois Department of Natural Resources and the Illinois Environmental Protection Agency. The rulemaking proposal is entitled Proposed Amendments To Dissolved Oxygen Standard 35 Ill. Adm. Code 302.206, and is assigned docket number R04-25.

Specifically, the proposal intends to reduce NOx emissions from stationary reciprocating internal combustion engines addressed in the NOx State Implementation Plan (SIP) Call Phase II. The proposal, docketed as In the Matter of: Fast-Track Rules Under Nitrogen Oxide (NOx) SIP Call Phase II: Amendments to 35 Ill. Adm. Code Section 201.146 and Parts 211 and 217 (R07-18), adds a new Subpart Q to Part 217 of the Board’s air regulations. The existing units subject to this rulemaking are specifically listed in Appendix G.

The Illinois Environmental Protection Agency (IEPA) proposal was filed on October 26, 2007 and docketed as In the Matter of: Water Quality Standards and Effluent Limitations for the Chicago Area Waterway System and Lower Des Plaines River Proposed Amendments to 35 Ill. Adm. Code 301, 302, 303, and 304 (R08-9).

  Document Illinois Pollution Control Board Adopts Amendments to Its Procedural Rules And Underground Storage Tank Regulations

November 15, 2007 - The Illinois Pollution Control Board, on November 15, 2007, sent to final notice a proposal amending its procedural rules and underground storage tank (UST) regulations. The proposed amendments, which are contained in docket Proposed Amendments to the Board’s Procedural Rules and Underground Storage Tank Regulations to Reflect P.A. 94-0274, P.A. 94-0276, P.A. 94-0824, P.A. 95-0131, P.A. 95-0177, and P.A. 95-0408 (35 Ill. Adm. Code 101.202, 732.103, 732.702, 734.115, 734.710) (R07-17), are intended solely to make the Board’s regulations consistent with recent amendments to the Environmental Protection Act (Act) (415 ILCS 5/1 et seq. (2006)).
