The Board affirmed the Illinois Environmental Protection Agency’s decision refusing to release any existing financial assurance tendered by ESG Watts for the facilities owned by ESG Watts.

The Agency “felt” that the “significant development” should be brought to the
Board’s attention and a new section needed to be added to the brief to do so.
R.Mot.S. at 3-4. Furthermore, the Agency argues that the brief had attached to it a “Verification
of Facts Not of Record by Certificate.” R.Mot.S. at 4. The Agency tenders a “correction” bystating that the certificate applies to the motion for extension of time. The court order was not before the Agency when theAgency’s decision was made.
