decision because, although the issues are similar, the unique facts surrounding this case require aseparate opinion and order.
The Agency acknowledges the lateness of the brief but asserts
that there was no “intention to willfully disregard the Hearing Officer’s scheduling order, causeany undue delay or any material prejudice to any party” nor was there “any bad faith” on the partof the Agency.
