The Board denied complainant’s motion for summary judgment in Count III only with respect to 35 Ill. Adm. Code 306.305(c) of the Board’s regulations. The Board granted complainant’s motion for summary judgment with respect to Sections 12(a), 12(c), and 12(f) of the Environmental Protection Act (415 ILCS 5/12(a), 12(c), 12(f) (2000)) and 35 Ill. Adm. Code 304.141(b), 306.102(a), 306.304, 309.102(a) of the Board’s regulations.
