  Document Board Adopts a Final Notice Proposal Concerning the Control of Mercury Emissions from Coal-fired Electric Generating Units

December 21, 2006 - The Illinois Pollution Control Board on December 21, 2006, adopted for final notice a proposal to control mercury emissions from coal-fired electric generating units (EGUs). The Illinois Environmental Protection Agency (IEPA), on March 14, 2006, filed the proposal docketed as In the Matter of: Proposed New 35 Ill. Adm. Code 225 Control of Emissions from Large Combustion Sources (Mercury) to satisfy the State’s obligation to submit a state implementation plan to address the requirements of Clean Air Mercury Rule (CAMR) and Section 9.10 of the Act. The rules would require Illinois coal-fired EGUs to reduce mercury emissions by an average of 90 percent by July 2009.

February 16, 2006 - The Illinois Pollution Control Board, on February 16, 2006, adopted amendments to the Board’s petroleum leaking underground storage tank rules. The amendments contained in the docket entitled Proposed Amendments To: Regulation of Petroleum Leaking Underground Storage Tanks (35 Ill. Adm. Code 732), R04-22(A) and Proposed Amendments To: Regulation of Petroleum Leaking Underground Storage Tanks (35 Ill. Adm. Code 734) R04-23(A), add new requirements in response to legislative changes in the leaking underground storage tank (UST) program.

  Document Board Adopts Amendments to Exemptions From State Permitting Requirements

March 2, 2006 - On March 2, 2006, the Illinois Pollution Control Board adopted for final notice revisions to the Board’s air construction and operating permit regulations. The revisions are included in this rulemaking, docketed as In the Matter of: Proposed Amendments To Exemptions From State Permitting Requirements (35 Ill. Adm. Code 201.146) (R05-19).

  Document Board Adopts Amendments to Radium Water Quality Standards

February 16, 2006 - On February 16, 2006, the Illinois Pollution Control Board adopted for final notice amended general use water quality standards for radium. The amendments contained in the docket entitled Revisions To Radium Water Quality Standards: Proposed New 35 Ill. Adm. Code 302.307 and Amendments To 35 Ill. Adm. Code 302.207 and 302.525 revise the general use water quality standard, applying the standard to combined radium 226 and 228, as opposed to the current standard applicable only to radium 226. The amendments also add a combined radium standard applicable to public and food processing water supplies.

  Document Board Adopts Amendments Updating Air Pollution Control Rules

May 4, 2006 - In a May 4, 2006 opinion and order, the Illinois Pollution Control Board adopted amendments designed to clarify, correct, streamline, and update numerous provisions of the Board’s air pollution control rules. The amendments are contained in the consolidated rulemaking dockets R04-20, captioned In the Matter of: Clean-Up Part III Amendments To 35 Ill. Adm. Code Parts 211, 218, and 219, and R04-12, captioned In the Matter of: Technical Corrections to Formulas in 35 Ill. Adm. Code 214 “Sulfur Limitations”.

  Document Board Adopts Regulations Establishing a Permit Program for Clean Construction or Demolition Debris Fill Operations for Final Notice

August 17, 2006 - On August 17 2006, the Illinois Pollution Control Board adopted regulations concerning clean construction or demolition debris fill operations. In the Matter of: Clean Construction or Demolition Debris Fill Operations Under P.A. 94-272 (35 Ill. Adm. Code Part 1100) (R06-19) proposes adding a new Part 1100 to the Board’s regulations. The Illinois Environmental Protection Agency (IEPA) filed this proposal on November 21, 2005.

  Document Board Adopts Revisions to the Board’s Regulations For Air Construction And Operating Permits

March 2, 2006 - The Illinois Pollution Control Board adopted for final notice, revisions to the Board’s regulations regarding exemptions from air construction and operating permit requirements. On March 2, 2006, the Board took this action on the rulemaking docketed as In the Matter of: Proposed Amendments to Exemptions From State Permitting Requirements for Plastic Injection Molding Operations (35 Ill. Adm. Code 201.146) (R05-20). The stated purpose of the proposal is to eliminate the burden of state construction and operating permitting of low emitting emission units and activities for both the Illinois Environmental Protection Agency and owners and operators of plastic injection molding operations.

  Document Board Cancels Hearing Schedule for a Proposal Concerning the Control of Mercury Emissions from Coal-Fired Electric Generating Units

May 4, 2006 - On May 4, 2006, the Illinois Pollution Control Board, on its own motion, decided to proceed with the Illinois Environmental Protection Agency’s (IEPA) March 14, 2006 proposal for rulemaking to control mercury emissions from coal-fired electric generating units (EGUs), pursuant to Section 27 of the Environmental Protection Act (Act) (415 ILCS 5/27 (2004)). The Board is proceeding under the authority of Section 27 of the Act in response to a preliminary injunction entered by the Sangamon County Circuit Court on May 1, 2006.

  Document Board Dismisses Proposed Amendments to Air Regulations Regarding Prevention of Significant Deterioration of Air Quality Permits

August 4, 2006 - On August 4, 2006, the Illinois Pollution Control Board granted a motion by the Illinois Environmental Protection Agency (IEPA) to withdraw its rulemaking proposal docketed as In the Matter of: Amendments to 35 Ill. Adm. Code 201 (New Section 201.501 PSD Construction Permits) (R06-27). This proposal, filed by the IEPA on June 20, 2006, would have added a section to the air regulations that eliminates an automatic 30-day stay of the effectiveness of prevention of significant deterioration of air quality (PSD) permits. The IEPA asserts that following the filing of this proposed rulemaking it had occasion to discuss the proposal with the United States Environmental Protection Agency, and, as a result, has concluded that at this time, the interests of its PSD program would be best served by a withdrawal of the rulemaking.

  Document Board Dismisses Rulemaking Pertaining to Professional Consulting Services Associated with the Underground Storage Tank Program

June 1, 2006 - The Illinois Pollution Control Board, on June 1, 2006, dismissed subdocket B Proposed Amendments To: Regulation of Petroleum Leaking Underground Storage Tanks (35 Ill. Adm. Code 732), R04-22B and Proposed Amendments To: Regulation of Petroleum Leaking Underground Storage Tanks (35 Ill. Adm. Code 734), R04-23B. The Board opened this subdocket to specifically address issues concerning the scope of work associated with lump sum payments as well as the lump sum payment amounts proposed at first notice in Subdocket A. The Board based its proposed language on a proposal by the Ad Hoc Work Group, a group formed by American Consulting Engineers Council of Illinois (ACECI) and Illinois Petroleum Marketer’s Association at the request of the Illinois Environmental Protection Agency (IEPA).

  Document Board Finalizes Changes to Its Administrative Rules

July 20, 2006 - The Illinois Pollution Control Board, on July 20, 2006, adopted amendments to its administrative rules. The Board’s administrative rules (2 Ill. Adm. Code 2175) address the Board’s organization, the types of Board proceedings, how to pay filing and copying fees, and how the public may access information. Amendments to these rules were needed primarily to: (1) codify statutory changes affecting the Board, including the reduction in the number of Board members from 7 to 5, as well as new requirements for posting meeting information on the Web; (2) reference the Board’s overhauled procedural rules (35 Ill. Adm. Code 101-130); and (3) update information about the Board, including how filings with the Board may be viewed, downloaded, and searched on-line through the Board’s Web-based Clerk’s Office On-Line (COOL).

  Document Board Finalizes Updates to Noise Rules

March 2, 2006 - On March 2, 2006, the Illinois Pollution Control Board adopted for final notice regulations concerning measurement of and standards for noise emissions in Illinois in the rulemaking entitled Proposed New And Updated Rules For Measurement and Numerical Sound Emissions Standards Amendments to 35 Ill. Adm. Code 901 and 910, (R03-9). The Board opened the rulemaking on February 20, 2003.

  Document Board Hearing on Proposed Regulations for Clean Construction or Demolition Debris Fill Operations

February 23, 2006 - The Illinois Pollution Control Board hearing on the rulemaking docketed as In the Matter of: Clean Construction Demolition Debris Fill Operations Under P.A. 94-272 (35 Ill. Adm. Code Part 1100 (R06-19), which was originally scheduled for March 1, 2006 at 10:00 am will instead begin at 2:00pm. The hearing is still being held at the Illinois State Museum Auditorium, 502 South Spring Street, Springfield, Illinois.

Code 734), R04-23B to establish a scope of work for activities associated with professional consulting services in the remediation of underground storage tank (UST) sites in Illinois.
