Pollution Control Board Denies Motion for Adoption of an Emergency Rule and Denies Motion for Expedited Review of an Alternative Rulemaking Proposal in a Rulemaking to Amend Nitrogen Oxides Emissions Regulations | |
August 20, 2009 - On August 20, 2009, the Illinois Pollution Control Board denied the Illinois Environmental Regulatory Group’s (IERG) motion for adoption of an emergency rule in the rulemaking entitled NOx Trading Program: Amendments to 35 Ill. Adm. Code Part 217 (R06-22). The Board determined that the record does not support a finding that an emergency exists. The Board also denied IERG’s motion for expedited review of an alternative rulemaking proposal in this docket. The Board determined that IERG’s proposed alternative language requires a new and separate rulemaking proposal. | |
