August 20, 2009 - On August 20, 2009, the Illinois Pollution Control Board sent to final notice a proposal to amend Parts 211 and 217 of the Board’s air pollution regulations. The proposal, filed by the Illinois Environmental Protection Agency (IEPA) on May 9, 2008, is docketed as Nitrogen Oxides Emissions from Various Source Categories: Amendments to 35 Ill. Adm. Code Parts 211 and 217 (R08-19). On both January 30, 2009 and March 23, 2009, the IEPA filed motions to amend the proposal based on negotiations with interested parties.

Code Part 223 Standards and Limitations for Organic Material Emissions for Area Sources (R08-17).

October 15, 2009 - On October 15, 2009, the Illinois Pollution Control Board adopted a final rule which sunsets the provisions for the Nitrogen Oxides (NOx) Trading Program rules for electrical generating units (EGUs). On April 21, 2009, the Illinois Environmental Protection Agency (IEPA) filed a proposal with the Board seeking the change. The proposal was docketed as In the Matter of: Nitrogen Oxide (NOx) Trading Program Sunset Provisions for Electric Generating Units (EGUs): New 35 Ill. Adm. Code 217.751 (Sept. 17, 2009). This rule becomes effective upon filing with the Illinois Secretary of State.

November 5, 2009 - On November 5, 2009, the Illinois Pollution Control Board accepted for hearing, and adopted for first notice, the rulemaking proposal docketed as In the Matter of: Reasonably Available Control Technology (RACT) for Volatile Organic Material Emission From Group III Consumer & Commercial Products: Proposed Amendments to 35 Ill. Adm. Code 281 and 219 (R10-10). This rulemaking was filed on October 23, 2009 by the Illinois Environmental Protection (IEPA) pursuant to the “fast-track” rulemaking provisions at Section 28.5 of the Environmental Protection Act (Act).

August 20, 2009 - On August 20, 2009, the Illinois Pollution Control Board proposed amendments to its special waste regulations and corresponding amendments to its used oil management standards. NORA, formally known as the National Oil Recycling Association, filed the original proposed rulemaking on December 13, 2005. On May 1, 2008, the Board adopted its original first notice proposal in Proposed Amendments to the Board’s Special Waste Regulations Concerning Used Oil, 35 Ill. Adm. Code 808, 809 (R06-20). After conducting a third public hearing at NORA’s request, the Board adopted for second first notice the amendments to its special waste and used oil regulations.

In the Matter of: Nitrogen Oxide (NOx) Trading Program Sunset Provisions for Electric Generating Units (EGUs): New 35 Ill. Adm. Code 217.751 (Sept. 17, 2009). After two public hearings, the Board adopted a second notice proposal identical to the May 7, 2009 first notice proposal published at 33 Ill. Reg. 8880 (June 26, 2009).

May 7, 2009 - On May 7, 2009, the Illinois Pollution Control Board authorized first notice publication, without comment on the merits, of an Illinois Environmental Protection Agency (IEPA) proposal that would sunset the provisions of the Nitrogen Oxides (NOx) Trading Program rules for electrical generating units (EGUs). The rulemaking proposal is docketed as In the Matter of: Nitrogen Oxide (NOx) Trading Program Sunset Provisions for Electric Generating Units (EGUs): New 35 Ill. Adm. Code 217.751. IEPA filed this proposal with the Board on April 21, 2009, along with a motion for expedited review requesting immediate first notice publication and the scheduling of hearings as soon as possible.

  Document Board Seeks Public Comment on Proposal to Update Volatile Organic Material Definition

October 1, 2009 - The Pollution Control Board, on October 1, 2009, adopted a proposal for public comment that would add two compounds to the list of those exempted from the definition of Volatile Organic Material (VOM). The update is needed to ensure that Illinois’ regulations reflect the United States Environmental Protection Agency’s (USEPA) most recent exemption of chemical compounds from regulation as ozone precursors. The proposal is docketed as In the Matter of: Definition of VOM Update, USEPA Regulations (January 1, 2009 through June 30, 2009) (R10-7).

April 16, 2009 - The Illinois Pollution Control Board, on April 16, 2009, adopted for second notice a rulemaking proposal to amend Part 225 of the Board’s air pollution regulations. The Illinois Environmental Protection Agency (IEPA) on October 3, 2008, proposed the rule which was docketed as In the Matter of: Amendments to 35 Ill. Adm. Code 225: Control of Emissions from Large Combustion Sources (Mercury Monitoring) (R09-10). Generally, the Board’s second-notice proposal seeks to recreate certain monitoring provisions of the federal Clean Air Mercury Rule (CAMR), which was recently vacated by a federal court. In addition, the Board’s proposal includes provisions offered by Ameren to amend the Multi-Pollutant Standard or MPS at Section 225.233 of Part 225. The Board found Ameren’s proposed language to be economically reasonable and technically feasible, noting that it projects an environmental benefit by reducing total emissions and that it is not opposed by IEPA, either procedurally or substantively.
