- 9. The Respondent did have a Contingency Plan at the Facility at the time of the
Illinois EPA inspection but the administrative employee on-site was unable to locate it and the
plan was provided to the .Illinois EPA at a later date. Adm. Code 739.122(c)(l), and Sections 2l(d)(2) and (e) of
the Act, 415 ILCS 5/2 I(d)(2) and (e)(20 12).
