On August 20, 2009, the Illinois Pollution Control Board denied the Illinois
Environmental Regulatory Group’s (IERG) motion for adoption of an emergency rule in
the rulemaking entitled NOx Trading Program: Amendments to 35 Ill.

alternative rulemaking proposal in this docket.
