On August 20, 2015, the Illinois Pollution Control Board adopted amendments to the Illinois regulations that are “identical-in-substance” to wastewater pretreatment regulations adopted by the United States Environmental Protection Agency (USEPA). The amendments update an incorporation by reference of the federal provision concerning appropriate methods for Clean Water Act analyses. On August 19, 2014, USEPA instituted a requirement for selection of only “sufficiently sensitive” methods for such analyses. This is not a wastewater pretreatment requirement, but it does apply to analyses performed for the purposes of the wastewater pretreatment program. In addition, the adopted amendments update all incorporations by reference to USEPA regulations and federal statutes to the 2014 edition, as a routine matter.
