Board Closes Chicago Area Waterways System and Lower Des Plaines River Subdocket E Rulemaking
On May 21, 2015, the Board adopted an order closing Water Quality Standards and Effluent Limitations for the Chicago Area Waterway System [CAWS] and Lower Des Plaines River [LDPR]: Proposed Amendments to 35 Ill. Adm. Code 301, 302, 303, and 304, R08-9(E). Subdocket E is the portion of the CAWS/LDPR docket that deals with water quality standards for Bubbly Creek. This docket was opened in order to defer a decision on Bubbly Creek while the U.S. Army Corp of Engineers (USACE) completed an ecosystem restoration study. The Board took official notice of the USACE website, which, as of the date of the order, indicated that a draft feasibility study had been completed, and the report released to the public. After the close of the comment period on the completed report, the report will be finalized and potential congressional authorization may be sought. Since the Board retained water quality standards for Bubbly Creek in Subdocket D, and given the status of the USACE project, the Board closed this docket.
