At its January 8, 2013 meeting, the Joint Committee on Administrative Rules (JCAR)
gave the Board’s December 6, 2012 second notice proposal the second notice review requiredunder the APA.
415 ILCS 5/26 and 27 (2010).
The Board has not held a
hearing on the proposed rule, as no hearing was requested during the first notice period.
Except as provided in
subsection (e) of this Section [relating exclusively to Section 34 (d) proceedings],4 members of the Board constitute a quorum, and 4 affirmative votes are required toadopt a Board decision.
