Finally, in count III, the People allege that Clinton violated the terms and
conditions of its permit, and thus Section 21(d)(l) of the Act (415 ILCS 5/21(d)( 1) (2008)), bycausing or allowing the emissions of offensive and malodorous landfill gas from the ClintonLandfill so as to unreasonably interfere with the use and enjoyment of the neighbors’ property,causing air pollution and an odor nuisance.
