HBC appeals on the grounds that “the contested conditions are not necessary to accomplish the
purposes of the Act or [Board] Regulations, are arbitrary, capricious, and unnecessary, arebeyond the Agency’s authority, and/or render certain permit sections ambiguous or internallyinconsistent.” Pet.
