I disagree with the majority on the “required-to-be-adopted” portion of the majority opinion.
I agree with the majority concerning the Board’s authority to consider whether or not a proposal filed pursuant to Section 28.5 may proceed under that provision.
Under Sections 27 and 28.5 of the Act, the Illinois Environmental Protection Agency has broad authority to bring proposals to the Board.
