On June 22, 2005, the parties filed a “stipulation of settlement and
dismissal of respondent’s petition for administrative review.” Under the proposed settlement,NMLP admits that it violated Section 21(p)(4) of the Act by causing or allowing open dumpingresulting in the deposition of waste in standing or flowing waters, and agrees to pay the civilpenalty of $1,500.
The Board accordingly assesses a civil penalty of
$1,500.
