Board’s decision addressed threepermit limitations and conditions appealed by Noveon, on all ofwhich the Board ruled against Noveon.
Further, the Board stated in its Opinion that it has not previously issued an
interpretation of Section 304.122(b) ofthe Board’s rules, by which Illinois EPA seeks to imposean ammonia limitation.
Noveon has shown that, as a matter of law, Illinois EPA’s decisions with respect to
imposition ofan ammonia limitation, the need for toxicity testing, and separation ofthe outfallsare not necessary to accomplishthe purposes and provisions of the Act.
