Sections 182(c)(4)(A) and Section 246 of the Clean Air Act (CAA) (42 U.S.C.
7511(c)(4)(A) and 7586 (1990)), require all serious, severe, and extreme ozone nonattainment
areas (NAA) to adopt a CFFP by May 15, 1994.
Reg.
9639 (July 25, 1997)), and the APA 45-day comment period began.
On November
12, 1997, JCAR issued a certificate of no objection. Tr. at 14. Finally, Mr. Burkharttestified that a one year delay in the CFFP would only have a minimal environmental impact.
