In this land enforcement action concerning a Lake County facility, the Board granted relief from the hearing
requirement of Section 31(c)(1) of the Environmental Protection Act (415 ILCS 5/31(c)(1) (2002)), accepted a final stipulation and settlement agreement, and ordered the respondent to pay a total civil penalty of $5,000, and to cease and desist from further violations.

stipulation, proposed settlement, and request for relief.
Section 103.302 also requires that the parties stipulate to facts called
for by Section 33(c) of the Act (415 ILCS 5/33(c) (2002)). The People and Cohen have satisfiedSection 103.302. The first additional payment is due by August 29,2003, which is the 120th day after the date of the order. Adm. Code 101.300(d)(2), 101.906, 102.706.
