this Board granted the first extension of variance toOctober 31, 1973, we anticipated Petitioner’s presentrequest for a further extension.
On August 7, 1973, an Agency representative visited
Petitioner’s facility to observe progress made and todiscuss the progress control program.
In obtaining easements, the
Agency is of the opinion that Petitioner has shown goodfaith in developing the 138 KV line and problems encounteredin said development are not self—imposed.
This Opinion constitutes the findings of fact and
conclusions of law of the Board.
