The Board has allowed the Agency until 15 days afterthe hearing in which to file its recommendation, The pro~cedural rules contemplate that the recommendation should befiled prior to the hearing (Section lO4~l8O(b)).
The petitioner
has a right to know in advance of the hearing whatfacts the Agency disagrees with and what disposition theAgency will recommend.
I therefore respectfully dissent.
