proceedings relevant to BRZ’s motions.
The status of materials as “solid wastes” is
significant because under the laws and regulations that Congress and the United StatesEnvironmental Protection Agency have established, only those materials that are “solidwastes” can be regulated as “hazardous wastes” under RCRA and corresponding Illinois lawsand regulations.
The Board therefore granted BRZ’s petition for an adjusted
standard, but modified the conditions that BRZ had proposed.
