On June 7, 1990, the Board issued an order in PCB 86-124
(permit appeal), directing Modine to file a response regardingwhether the issues in the permit proceeding were moot as a resultof the Board’s determination in P87-36.
The Board notes, however, that the
limits proposed in the instant case are, in large part, thelimits sought in the site-specific proceeding.
Nodine’s response
should be filed on or before July 27, 1990.
