The Board granted complainant’s motion for summary judgment and denied respondent’s motion for summary judgment. The Board found that this Sangamon County respondent violated Sections 21(p)(1) and (p)(7) of the Act (415 ILCS 5/21(p)(1), (p)(7) (2000)), and ordered respondent to pay a civil penalty of $3,000.
The Board recently adopted its own procedural rules dealing specifically with
administrative citation practice and procedure before the Board.
Consistent with the rationale behind the
administrative citation process, the Board’s new procedural rules, which took effect January 1,2001, contemplate that the hearing on an administrative citation be held within 60 days afterfiling of a petition for review.
