In this air enforcement action concerning a Coles County facility, the Board granted relief from the hearing requirement of Section 31(c)(1) of the Illinois Environmental Protection Act (415 ILCS 5/31(c)(1) (2000)), accepted a final stipulation and settlement agreement, ordered the respondents to pay a civil penalty of $5,000, and to cease and desist from further violations.

Accordingly,
the Board grants a waiver from the hearing requirement.
Respondents shall continue to comply with any federal, State, or local regulations
including, but not limited to, the Act and the Board’s regulations.
Such
payment must be made by certified check or money order payable to the IllinoisEnvironmental Protection Agency, for deposit in the Environmental ProtectionTrust Fund.
Illinois Supreme Court Rule 335 establishes such filing requirements.
