Document Board Adopts Final Amendments to General Use Water Quality Standards for Dissolved Oxygen

January 24, 2008 - On January 24, 2008, the Illinois Pollution Control Board adopted final amendments to Illinois’ dissolved oxygen (DO) general use water quality standards (35 Ill. Adm. Code 302.206). The amendments are based on aspects of both the proposal filed by the Illinois Association of Wastewater Agencies and the joint proposal filed by the Illinois Department of Natural Resources and the Illinois Environmental Protection Agency. The rulemaking is entitled Proposed Amendments To Dissolved Oxygen Standard 35 Ill. Adm. Code 302.206 (R04-25).

May 1, 2008 - The Illinois Pollution Control Board, on May 1, 2008, sent to final notice a proposal that seeks to refine when an unpermitted release of radionuclides must be reported to the Illinois Environmental Protection Agency (IEPA). The rulemaking is docketed as, Procedures Required by PA 94-849 For Reporting Releases of Radionuclides at Nuclear Power Plants: New 35 Ill. Adm. Code 1010 (R07-20).

September 4, 2008 - The Illinois Pollution Control Board, on September 4, 2008 sent to final notice the rulemaking docketed as Triennial Review of Sulfate and Total dissolved Solids Water Quality Standards: Proposed Amendments to 35 Ill. Adm. Code 302.102(b)(6), 302.102(b)(8), 302.102(b)(10), 302.208(g), 309.103(c)(3), 405.109(b)(2)(A), 409.109(b)(2)(B), 406.100(d); Repealer of 35 Ill. Adm. Code 406.203 and Part 407; and Proposed New 35 Ill. Adm. Code 302.208(h) (R07-9). The Board sent this rulemaking to final notice making only slight changes as suggested by the Joint Committee on Administrative Rules (JCAR). JCAR voted to issue a certificate of no objection on August 19, 2008.

  Document Board Sends to First Notice a Proposal to Amend Special Waste Regulations Concerning Used Oil

May 1, 2008 - On May 1, 2008, the Illinois Pollution Control Board sent to first notice a proposal to amend the Board’s regulations concerning special waste classifications and nonhazardous special waste hauling pertaining to used oil recycling in Illinois (35 Ill. Adm. Code 808, 809). On January 5, 2006, the Board accepted for hearing the rulemaking entitled In the Matter of: Proposed Amendments to the Board’s Special Waste Regulations Concerning Used Oil, 35 Ill. Adm. Code 808, 809 (R06-20). NORA, formally known as the National Oil Recycling Association, filed the proposed rulemaking on December 13, 2005. The Board is proceeding to first notice with NORA’s proposal, as amended by the Illinois Environmental Protection Agency (IEPA).

Adm. Code 302.102(b)(6), 302.102(b)(8), 302.102(b)(10), 302.208(g), 309.103(c)(3), 405.109(b)(2)(A), 409.109(b)(2)(B), 406.100(d); Repealer of 35 Ill. Adm. Code 406.203 and Part 407; and Proposed New 35 Ill. Adm. Code 302.208(h) (R07-9). The Board is proceeding to proposed second notice because the Board is amending the first-notice rule language and is requesting comments on the Board’s proposed second-notice changes. The Board will accept comments that are filed by June 2, 2008 regarding the Board’s proposed second-notice changes before proceeding to second notice.

On May 1, 2008, the Board adopted a proposed second notice because the Board amended the first-notice rule language and the Board requested comments on the proposed second-notice changes. The Board received one comment from Prairie Rivers Network, Sierra Club and the Environmental Law and Policy Center. The Board amended the proposed second notice language concerning mixing zones in response to the comment.

December 18, 2008 - On December 18, 2008, the Board accepted for hearing a proposal to amend Part 243 of the Board’s air regulations to incorporate new federal air quality standards. The Illinois Environmental Protection Agency (IEPA) filed the proposal on December 1, 2008.

June 5, 2008 - On June 5, 2008, the Illinois Pollution Control Board accepted for hearing a proposal to amend Parts 211 and 217 of the Board’s air pollution regulations. The proposal, which was filed by the Illinois Environmental Protection Agency (IEPA) on May 9, 2008, is docketed as In the Matter of: Amendments to 35 Ill. Adm. Code 217, Nitrogen Oxides Emissions, and 35 Ill. Adm. Code 211 (R08-19).

  Document Board Will Hold Hearings on Proposed Amendments to Groundwater Quality Rules

March 20, 2008 - The Illinois Pollution Control Board, on March 20, 2008, accepted for hearing a rulemaking proposal to amend the Board’s groundwater quality rules. On February 19, 2008, the Board received a rulemaking proposal from the Illinois Environmental Protection Agency (IEPA) to amend Part 620 of Title 35 of the Illinois Administrative Code (35 Ill. Adm. Code 620). This rulemaking is docketed as Proposed Amendments to Groundwater Quality Standards, 35 Ill. Adm. Code 620, (R08-18).

April 17, 2008 - The Illinois Pollution Control Board on April 17, 2008 directed the Clerk to withdraw the first-notice publication of the rulemaking proposal docketed as In the Matter of: Section 27 Proposed Rules for Nitrogen Oxide (NOx) Emissions From Stationary Reciprocating Internal Combustion Engines and Turbines: Amendments to 35 Ill. Adm. Code Parts 211 and 217 (R07-19).

  Document Pollution Control Board to Consider Amending Rules for Tiered Approach to Corrective Action Objectives (TACO)

September 16, 2008 - The Illinois Pollution Control Board, on September 16, 2008, accepted for hearing an Illinois Environmental Protection Agency (IEPA) proposal to amend the Board’s rules concerning the Tiered Approach to Corrective Action Objectives (TACO). As IEPA states, the TACO rules provide “procedures for developing remediation objectives based on various risks to human health posed by environmental conditions at a site.” On September 3, 2008, IEPA filed the pending rulemaking proposal, which the Board has docketed as In the Matter of: Proposed Amendments to Tiered Approach to Corrective Action Objectives (35 Ill. Adm. Code 742) (R09-9).

  Document Proposed Amendments to Illinois’ Mercury Rule Go To First Notice

November 5, 2008 - On November 5, 2008, the Illinois Pollution Control Board accepted for hearing a proposal from the Illinois Environmental Protection Agency (IEPA) to amend Part 225 of the Board’s air pollution regulations. IEPA’s proposal seeks to recreate certain monitoring provisions of the federal Clean Air Mercury Rule (CAMR), which was recently vacated by a federal court. The IEPA filed the measure with the Board on October 3, 2008. The proposed rule was docketed as In the Matter of: Amendments to 35 Ill. Adm. Code 225: Control of Emissions from Large Combustion Sources (Mercury Monitoring) (R09-10). In its November 5, 2008 order, the Board also granted the IEPA’s motion for expedited review of the proposal. The Board directed the Clerk to cause publication of the proposal in the Illinois Register for first notice without commenting on its substantive merits.
