The Board found that the Illinois EPA’s proposal met the procedural requirements

While the Agency answered most of the Board’s questions
on the Record at the hearing, there were a handful of questions that required follow up or additional information.
Mr. Koch testified that he found
chronic standards in other states ranging from 0.95 mg/L to 5.0 mg/L. See, June 21, 2011 transcript at 34. Individual aquatic life use criteria derived in this manner are often not promulgated in State regulations.
