LINCOLN LAND FS, INC. Agrichemical Containment Structures (Property Identification Number 09-21-404-007) v. ILLINOIS ENVIRONMENTAL PROTECTION AGENCY
Upon receipt of the Illinois Environmental Protection Agency’s recommendation, the Board found and certified that specified facilities of Lincoln Land FS, Inc. located in Scott County are pollution control facilities for the purpose of preferential tax treatment under the Property Tax Code (35 ILCS 200/11-10 (2002)).
Under the Property Tax Code, “[i]t is the policy of this State that pollution controlfacilities should be valued, at 33⅓% of the fair cash value of their economic productivity to theirowners.” 35 ILCS 200/11-5 (2002); see also 35 Ill.
Agency Recommendation (Agency
Rec.) at 1.
On August 30, 2004, the Agency filed a recommendation on the application with the
Board.
Adm.
Code 125.216(d) (quoting in italics 35 ILCS 200/11-30 (2002)). The Clerk therefore will
provide Lincoln Land FS and the Agency with a copy of this order. Adm. Code 101.902, 102.700, 102.702.
