hearing briefs were filed by both parties. Exhibit 1 contains photographs of certainportions of the area surrounding the CDT landfill, and an affidavit purporting to providefoundation for the photographs. However, thephotographs in Exhibit 1 were not before the City at the time of decision, and, in fact, werenot taken until two to three months after the decision was made.
