Clearly the construction was of a type which is
prohibited in the absence of a permit.
Prior to the enactment of the Environmental Protection Act on
July 1, 1970, it was not necessary to obtain a State permit forinstallation of new equipment within the City of Chicago, sincethat area had been exempted from State requirements.
The violations took place before our decision
of January 6, 1972 gave final notice of the need for State permitsin construction of Chicago facilities.
