In all respects but two, the appellate court rejected the
challenges to the Board’s landfill regulations.
1009.5(c), specifically provides that the public hearing and
comment provisions of Section 27(b) of the Act, the EconomicImpact Study (EcIS) requirements, shall not apply to the airtoxics contaminants list rulemaking.
