NEW YORK SITING PROCESSIn the State of New York, applications to construct and operate an electric generatingfacility with a capacity of 80 MW or more are ruled upon by the New York State Board onElectric Generation Siting and the Environment (NYS Siting Board) after various filings andhearings.
  • During the siting process, the applicant must carry out a meaningful public involvement
program.
  • The
DEC must provide the permits to the NYS Siting Board before that board decides whether to approve siting by granting the applicant a Certificate of Environmental Compatability andPublic Need.
