The Agency’s August 27, 1980 motion to strike and to grant
sanctions was mooted by the Order of September 4, 1980 (althoughsaid motion was referred to incorrectly as being filed on August29, 1980).
Regardless of whether the Board would be inclined to
grant sanctions against Celotex, such action is “discovery—related.”It therefore would be inconsistent with its prior order for theBoard to issue orders related to discovery—related motions.
