ORDER OF THE BOARD (by M. McFawn):
On January 11, 2001, petitioner Broderick Teaming Company (Broderick) filed with the
Board a motion for extension of time to file motion for reconsideration. Broderick stated that on
January 10, 2001, the Illinois Environmental Protection Agency (Agency) served Broderick a
motion for reconsideration of the Board’s December 7, 2000 order. Broderick Teaming
Company v. Illinois Environmental Protection Agency (December 7, 2000), PCB 00-187.
Broderick stated that this motion was unexpected, and that Broderick may desire to file its own
motion for reconsideration.
On January 17, 2001, Broderick filed a second motion for extension of time, to file (1) a
motion for reconsideration and 2) a response to respondent’s motion for reconsideration. In this
second motion, Broderick stated that the parties have initiated settlement discussions, but the
parties are unable to meet until January 26, 2001. Broderick represented that both parties agreed
that Broderick should file the January 17, 2001 motion for extension of time, and further
represented that the Agency’s counsel has no objection to this motion.
Pursuant to the Board’s procedural rules, motions for reconsideration must be filed within
35 days of adoption of a final Board order. 35 Ill. Adm. Code 101.520(a).

December 7, 2000, is January 11, 2001, the day after the Agency served Broderick with its
motion for reconsideration. Based upon its second motion, Broderick now requests until January
26, 2001, to file a motion for reconsideration, and until January 31, 2001, to respond to the
Agency’s motion for reconsideration.
The Board grants Broderick’s motion. Broderick has until January 26, 2001, to file a
motion for reconsideration of the Board’s December 7, 2000 order in this matter, and until
January 31, 2001, to file a response to the Agency’s motion for reconsideration.
