County Solid Waste Management Department, a delegated county of the Illinois
Environmental
Protection Agency by
Section 31.1 of

Environmental

FACTS
1.
That Respondent, Veolia ES Valley View Landfill., is the permitted owner
and
operator of a facility located
at
1363 Bear Road, Decatur, Macon County,
Illinois.
2.
That Timothy D. Curry is the Certified Operator of the above-referenced facility.
3.
That said facility is operated as a sanitary landfill, operating under Illinois
Environmental Protection Agency Permit No. 1995-198-LF, and is designated with

VIOLATIONS
Based
upon direct
observations made
by Laurie Rasmus
during the course of
her
December
2, 2009
inspection
of the above-referenced
facility, the
Macon County Solid
Waste
Management
Department
has
determined
that Respondents
violated the Illinois
Environmental
Protection
Act
(hereinafter,
the “Act”) as
follows:
(1)
That
Respondents conducted
a sanitary landfill
operation in a
manner which
resulted
in a manner
which results in leachate
flows entering waters
of the
State.,
a
violation
of Section 21
(o)(2) of the Act, 415
ILCS 5/21 (o)(2) (2006);
and
(2)
That Respondents
conducted
a sanitary
landfill operation
in a
manner which
results in
leachate flows exiting
the landfill confines
(as determined by
the
boundaries established
for
the
landfill
by a permit issued
by
the Agency),
a
violation of Section 21
(o)(3)
of the
Act, 415 ILCS 5/21
(o)(3)
(2006); and

That Respondents
conducted
a sanitary landfill operation in
a
manner
which
resulted in uncovered
refuse remaining
from a previous operating day,
a
violation
of Section 21(o)(5) of the
Act, 415 ILCS 5/21(o)(5) (2006);
and
(4)
That Respondents
conducted
a
sanitary
landfill operation in a manner which
resulted
in
failure
to collect and
contain litter at the end of the operating
day, a
violation of
Section 21(o)(12) of the Act,
415 ILCS 5/21(o)(12) (2006).
CIVIL PENALTY
Pursuant to Section 42(b)(4) of
the Act, 415 ILCS 5/42(b)(4) (2006),
Respondents are
subject to a civil penalty of Five Hundred
Dollars
($500.00)
for each of the violations
identified
above, for a total of Two Thousand Dollars
($2,000.00). If Respondents elect
not to petition the
Illinois Pollution Control Board, the
statutory civil penalty specified above shall
be due and
payable no later than June
30
2009,
unless otherwise provided
by order of the Illinois Pollution
Control Board.
If Respondent elects
to contest this Administrative Citation
by petitioning the Illinois
Pollution Control Board in
accordance with Section 31.1 of
the Act, 415 ILCS 5/31.1 (2006),
and
if the Illinois Pollution Control Board issues
a
finding
of violation(s) as alleged herein, after
an
adjudicatory
hearing, Respondent
shall be
assessed
the
associated hearing costs incurred
by
the Macon County Solid Waste Management
Department and the Illinois Pollution
Control
Board. Those hearing costs shall be assessed
in addition to the statutory civil penalty
of Two
Thousand
Dollars ($2,000.00).
Pursuant
to
Section
31.1(d)(1) of the Act,

fails to petition or elect not
to
petition the Illinois
Pollution Control Board for review
of this

Report Narrative
A routine inspection of the Veolia
ES
Valley
View Landfill
(VVLF)
was
conducted
on December 2, 2009
between
the hours of 6:15 am. and 10:04 am. by Laurie Rasmus
(author of this report), representing the Macon County Solid Waste Department.
Weather conditions consisted of cloudy
skies,
an air temperature near
30
degrees
Fahrenheit and
winds of approximately
5 mph from the east.
Forty-two
photographs were
taken and no samples were collected. Kim Frye,
VVLF scale operator, and Robert Tindell, VVLF operations staff, and Rick Presser,
Operations Manager of Veolia ES Cranberry Creek Landfill in Wisconsin Rapids were
interviewed on-site. Telephone conversations with Tim Curry, Veolia ES Regional
Engineer,
occurred following the site inspection.
This
inspection was conducted
in accordance with Section 4(c) and (d)
of
the
Illinois Environmental Protection Act (“Act”). The purpose of this inspection was to
determine if the site is in compliance with the Act and Regulations.
Site History and Permitting
Veolia ES
Valley View Landfill (VVLF)
has
two permits. Unit I has been closed
since
1970. It is governed by Permits 1976-4-DE, 1978-7-DE, and 1979-18-DE. The
most current
supplemental permit is 2008-297-SP, which was issued on July 31, 2009.
The
supplemental permit approves the annual evaluation of the
effectiveness
of the
remedial
activities based on Groundwater Monitoring Zone (GMZ) monitoring.
Unit 2 is governed by permit 1995-198-LF which has two recent modifications.
Modification #66
approves an annually
updated
closure
and post-closure
cost
estimate
(Log No.
2009-279) and the use of anaerobically digested sewage (POTW) sludge
as
an
alternate daily
cover
(Log No. 2009-318).
Modification
#67 approves the annual
Evaluation of
Remedial Action for 2008 for
Units
2 and
3.
The current permit for this
facility
expires on May 1, 2011.
Prior to this inspection of December 2, 2009, the most recent inspection of this
facility was conducted on
November 13,
2009.

Personnel
Changes
On
November
30,
2009
Tim
Curry, Veolia
ES
Regional
Engineer,
telephoned
to
inform
me that
Mr.
Robert
Fosnock
had resigned
as
VVLF
Operations
Manager
and
his
employment
period
ended
the preceding
Friday.
Mr. Curry
indicated
that
an operations
manager
from
a
northern facility
would
temporarily
serve
at
the
VVLF during
the time
of
transition.
He
also communicated
that he
would
be
at the WLF
more
often than
usual.
Mr.
Curry
also
informed
me
that Mr.
Robert “Paul”
Whittaker
was
terminated
on
November
23,
2009 from
his position
as
the
General
Manager
at
VVLF
and over
the
local
Veolia
ES
hauling
operation.
He explained
that
Chris
Rooney
of Veolia
ES
would
oversee
the
hauling
operations
during the
interim.
nspection
(Part
I of
2)
At 6:15
a.m.
on December
2, 2009 I
arrived
at the site.
From
the office
parking
lot,
I
observed
that
the flare was
operational,
hauling
vehicles
were
at the
active area
and
Kim Frye,
VVLF
scale operator,
was in
the scale
office.
I exited
my vehicle
and
asked
Ms. Frye
to
notify
Robert
Tindell
that
I was
on site.
Ms. Frye
said that she
would
do so.
I drove
along
the
perimeter
of the
landfill
and
parked
southwest
of the active
face. Landfill
odors
were
noticeable
on the
west
and
north sides
of the landfill
as
well
as
the
active area.
Robert Tindell,
who
was seated
in the dozer,
drove
to
where
I was parked
and
we
both
exited our
vehicles.
I mentioned
that my
intent was
to
observe
the uncovering
of
the waste
expecting
a 7:00 a.m.
opening.
Mr. Tindell
explained
that
he received
word
at 3:30
p.m.
on
the previous
day
that the facility
was
to open
at 6:00
a.m.
the
next
morning.
Mr. Tindell
informed
me that Rick
(referring
to Rick
Presser,
Operations
Manager
of Veolia
ES
Cranberry
Creek
Landfill
in
Wisconsin
Rapids)
had
arrived
yesterday.
Regarding
the
day’s opening
activities,
Mr.
Tindell said
that he
removed
two
tarps and
that six
Veolia
hauling
vehicles
had already
tipped
waste.
He stated
that
recently
a
tanker
of
leachate
is being transported
from the
facility
on
a daily basis
and
leachate
is being
re-circulated
to increase
compaction.
During our
conversation,
I
noticed a
truck
with
a tanker
enter the
facility. Concerning
the two areas
which
were
each
covered
by
a
single
tarp,
Mr. Tindell
said that
they
typically
utilize
those areas
on
Saturdays.
Referring
to
my
observation
of the
random load
check
which Mr.
Tindell
conducted
during
my
previous
inspection,
I
mentioned
that
I expected
the load
to be
tipped
away
from the
day’s active
area.
I asked Mr.
Tindell if
he
was able
to adequately
determine
the
contents
of the
load. He
explained
that by taking
numerous
swipes
across
the
waste
to
divide
it into
one-foot
lifts, he felt
he was
able
to view
the
contents.
Mr.
Tindell
returned
to
the dozer
and I walked
east
to a
higher
elevation
to view
the active
area
(photo
1). I then
walked
along
the
south
and west
sides
of the
active
area
(photos
2
& 3)
and between
the tarped
areas.
Litter,
primarily
plastics,
was
present
in the areas
adjacent
to the tarps
and
active face.
After observing
a
number
of
hauling
vehicles
tip
waste, I drove
from
the
area.

While
on the perimeter
hauling
road at the southwest
corner
of the landfill, I
saw
a tanker
truck drive
east on the hauling
road adjacent
to the shop. I noticed
that the
steel doors
to the leachate
vaults
labeled
L307
and L306 were open.
All of the
three
valves
in
the L306
vault
were in the
open position and
landfill
gas
odors were prevalent
in the
area. A hose exited
the L306
vault
and was
inserted in an uncapped
pipe
to the
northwest
(photo 4).
Approximately
twenty-five feet
northeast
of L306, black-colored
liquid with
areas
of
light-colored foam
that
appeared
to be leachate,
was present
along the
base
of the
rip-rap
downlet
at the toe of the
south slope (photos
5 & 6).
Approximately thirty
feet
farther
to the
east another apparent
leachate
seep of approximately
ten feet
in length
was
present
at
the
toe
of the
slope (photo 7). The
liquid had
a sheen of multiple
colors
on its surface
and contained areas
of foam.
It gave the
soil a black-stained
appearance
and
clouded the
pooled water
of the drainage ditch
a black
color.
Walking
approximately
60
feet
to the
southeast
to
an area
southeast
of GB
6S,
the
odors became
of greater
intensity and shallow
pools of
orange-colored liquid
were
present (photo
8).
The
outlet
to
the dewatering
well was beyond
these
by a
few feet
to
the east
(photo
9).
I
crossed the
hauling road
to the south and entered
the Gradient
Control Effluent
Treatment
System (GCETS)
area.
Strong odors were
noticeable northwest
of the
aerator unit
and in close proximity
to
the
unit. The
water,
plants and fixtures
appeared
to have an orange
cast.
While I was in the
GCETS, I saw
Billie Sims, VVLF
employee,
close the
steel doors to L306
and then leave
the area.
Returning
to the haul road,
I
observed
where leachate was
apparently
present
on
the road in an area
approximately
60 feet west of
L306. Liquid
was pooled along
approximately
a
twenty
foot
length
along the north
edge of the road
(photo II). The
liquid
appeared
to be
pooled
in tire
ruts and was
green at the bottom
with floating
black
swirls and
an oily sheen
on the surface.
I
photographed
segments of the
area in an
east
to west sequence (photos
12-15).
I walked around
the
southwest
corner of the
landfill, noticing
ammonia
odors, and viewed
the L307
leachate vault (photo
16).
I returned
to
my vehicle
and drove
east
along
the
haul road. I observed
an area
on the south
slope that appeared
to be
recently
graded where
waste
was
exposed.
I
walked up the
slope, seeing that
the area encompassed
an area of approximately
50
feet
in diameter
and a well labeled
EW-52 (photos
17-20). Waste
was
on
the surface
as
well as embedded
in the soil. A
partial
list of
the waste items includes:
plastic
sheeting,
plastic containers
and fragments,
a blanket, fabric
pieces,
a
rusty metal rod, rusty
pipe,
carpet and foam
carpet pad.
Approximately
thirty
feet
northeast of EW-52
were shallow
pools
of greenish
liquid with a
layer of scum on
the surface (photos
21
&
22). It
appeared as
though
the
area had
recently been driven
on, leaving tire
impressions.
Continuing
up the slope
to
the
diagonal
diversion
berm
on the east Sections
of
Unit
II, I observed that
a
nIl was
• present along
the upslope
side of the diversion
berm (photos
23 & 24).
Along the length
of the
nIl, an orange-colored
liquid with
an
oily
purple sheen
was present.
Continuing
to
walk up-slope, I
passed
through
another area that
appeared to
be
recently
graded with waste
on the surface
and embedded
in the soil
(photo 25).
A
partial
list of the waste
items
includes:
vinyl siding,
compacted
plastic and textile
material.

Along
the shoulder
of
the
slope,
a
greenish
pool
of water
was present,
stretching
from
the vicinity
of
EW-32
and
eastward
(photo
26). It
appeared
as
though
soil
settlement
had recently
occurred
around the
base of
EW-32
as
cracks were
visible
and
an
abrupt
elevation
change of
4-6”
was present.
Farther
to
the east at
the
shoulder
of
the
slope and
along
the haul
road over
the
top
of
the
landfill, it
appeared
as
though
an
area
had
recently
been excavated
and/or graded
(photo
27).
From
the
eastern section
of the shoulder
of the
south
slope
of the
landfill, I
descended
southwest
along
the
diversion
berm.
Observing
the nIl that
was
upslope
of
the
berm,
I noticed
the point
of highest
elevation
where
the
leachate
became
visible
on
the
soil surface.
I
recorded
waypoint
219 (N39.82127,
W89.04323)
at
the location
(photo
28). I continued
southwest
along the
berm, observing
leachate
throughout
the
length
of
the adjacent
nIl (photo
30), to the
opening
of the downlet
(photo
29 & 31).
The
area
of the
downlet
was
permeated
with
ammonia
odors
and contained
pools of
orange
colored
liquid.
I then
walked
south,
down the
south
slope,
and
observed
an
orange
colored
liquid,
with
a layer
of film
with
an
oily
appearance
on portions
of
the surface,
pooled
at
the
south end
of the
downlet
pipe
(photos
32-33).
The path
of
the
liquid in the
pool
appeared
to
descend southeast
into the
drainage
ditch which
connected
with two
culverts
that stretched
beneath
the
haul
road (photo
34). A ditch
from
the north
also
appeared
to feed
into the two
culverts
(photos
34
& 35).
The
south
sloping
area
between
the
south
ends of
the culverts
and the
south sedimentation
pond
(photos
36
&
37),
contained
greenish
colored
water.
Records
Review
Deciding
to
try to make
contact
with
the Interim
Operations
Manager
(Rick
Presser),
I drove
to
the office
building.
Tamyra
Meyers
and
Jenny
Taylor,
Veolia
ES
office
staff,
indicated
that
Mr.
Presser
was on the
landfill
and they
would
ask him to
meet me
at the office.
While
waiting,
I went
to
the
scale
office and
asked Kim
Frye,
VVLF
Scale
Operator,
if I
could
view
the Random
Load Inspection
Log. She
affirmed
my
request and
I
found
the
log
in its usual
location.
The November
13, 2009
entry for
the
11:05
a.m.
inspection
corresponded
with my
observations
at the
active
face
during
my
previous inspection
of November
13,
2009. The
log also
recorded
random
load
checks
at
7:21
a.m.
and
9:11 a.m.
on the
same day.
The random
loads
log
book contained
records
for three
inspections
each
day
for
the
following
dates
in
September
through
November
2009: September
4, 11, 18,
25
(all
Fridays);
October
2, 10,
16, 23,
30 (three
Fridays
and a Saturday);
November
6,
13,
20,
23
(three
Fridays
and
a Monday).
I asked
Ms. Frye
what
process is
followed
to determine
which
loads are
inspected
for
the random
checks.
Ms.
Frye
said,
“It’s totally

the landfill
together
and
we
left the

area in
his
vehicle.

As we drove
along
the
west slope of
the landfill I pointed
out
two areas
with
apparent leachate outbreaks
(photos

Continuing along
the south side
of the
landfill
I commented
on my
observations of apparent
leachate
in the nh upslope
of
the
east diversion
berm
on the
south
slope of the landfill
(photos
23-24).
I explained that
apparently
the leachate
descended
in the nIl (photos
24 & 30), entered
the downlet
(photos
29-31), exited
the bottom of the
downlet
(photos
32-33), entered
the
drainage
ditch (photos
34-35), entered
the two culvents
under the
hauling road
(photo 36) and
descended
south to the south
sedimentation
pond (photo 37).
I pointed
out the exposed
waste on the
south slope
(photos
17-20).
Mr. Presser
commented that
it appeared
as
though
some work had recently
occurred
around the
well,
referring
to EW-52. I also
explained my
observations in
the southwest
section
of
the landfill regarding
the
apparent
leachate
outbreaks,
discolorations
and odors
in
the
GCETS
(photos 4-15).
As we continued
along the west
side of the
landfill with the windows
of
the
vehicle raised,
odors
became more noticeable
and
odors continued
as we drove along
the north
side and into the
active area.
I commented that
I
had observed
significant
litter on
the soil surfaces in
the area. Mr.
Presser mentioned
that a light
duty worker
was
on site for
the
day.
Regarding the active
area Mr.
Presser said, “My
goal at the end
of the week,
I hope to eliminate
some of
these tarps.” I mentioned
that
my main
concern was
that
leachate
was
apparently entering
the
south sedimentation
pond.
Mr.
Presser
replied, “The head behind
them
is extreme.”
He voiced
concern
that
“opening
them up” might
create
a
greater flow.
We
left
the
active area
and drove around
the perimeter
of the landfill
and then
ascended the
haul road on
the east side of
the Unit II.
In regards to the disturbed
soil
area
(photo 27),
Mr. Presser
thought that work on
the
road
must have recently
taken
place.
We turned
around,
descended onto
the hauling
road on the
east
side
of the Unit
II
and turned
west onto Hill
Road. Billie
Simms was on
the north side of
the perimeter
fence.
Mr. Presser stopped
to ask Mr.
Simms about the
hose
that connected

and
the
uncapped
pipe. Mr.
Sims said, “It collects
groundwater.”
We
observed another
apparent
leachate
outbreak
at
the
toe
of the north slope
(photo
42).
Mr. Presser then
dropped
me off at my
vehicle
in
the parking lot.

to
the
southeast
section
of
the
landfill
and photographed
the west
side
of
the Unit
I
south
section referred
to as Florida
(photo
38).
It appeared
that water
had
recently
receded
from the
area leaving
a
layer
of
silt on the
grassy slope.
At
the
toe
of the east
slope
of
the
Unit II landfill,
north
of the
southeast
corner,
an
apparent
leachate
seep
was present
on
an
area
of disturbed
soil of
approximately
thirty
feet north-south
by
fifteen
feet
east-west
(photos
39-40).
Portions
of
the soil
appeared
blackened
and
the
liquid
of the apparent
leachate
seep was
black in
color with
an oily
sheen.
Approximately
60 feet
north of this
area was
a second
apparent
leachate
seep
on an area
of
disturbed
soil of approximately
70
feet north-south
by
twenty feet
east
west
(photo 41).
The
apparent
leachate
was orange
colored
with
an oily sheen.
At
the
toe of the
north slope
of the
landfill,
the
appearance
of
another
leachate
seep
was present
(photo
42).
The length
of the
apparent
seep was
black
in
color. The
water
in
the drainage
ditch
was
a
brownish
color
with an orange
colored
area
directly
below
the apparent
seep.
Post-Inspection
Interviews
At 11:21
a.m.
on December
2,
2009
I returned
Mr.
Presser’s
telephone
call
to my
office
telephone
at
10:48
a.m. Mr.
Presser
said
that the
pond in
the
GCETS was
typically
orange
colored since
it
receives
water
from
the gradient
control
pump
in Unit
I.
Regarding
the odors
at the
GCETS,
Mr. Presser
said
it was “normal
odor
for
groundwater
that
comes
out of a gradient
control
system.”
I
commented
that
my
primary
concern
was
that
the
apparent
leachate
was entering
the
south
sedimentation
pond.
At 11:45
a.m.
on December
2, 2009
Tim Curry
telephoned.
He said that
the
discoloration
in the GCETS
is
caused by
iron.
I
explained
my other
concerns
regarding
apparent
leachate
outbreaks
and
exposed
waste.
Regarding
the
exposed
waste
area,
Mr. Curry
volunteered
that
work
around
EW-52
had recently
occurred.
I
referred
to my
notes and
confirmed
that EW-52
was
the location
of the
area
with
exposed
waste.
As
we continued
the
conversation
we addressed
the leachate
issues.
Mr. Curry
asked me
what Mr.
Presser
had
told
me
during the
inspection.
I
said that
Mr. Presser
had
acknowledged
the
problems
and
said that
he had concerns
about
opening
up
the
areas
due
to the
Ieachate
head
levels.
Mr. Curry
emphasized
that
the
leachate
heads
are
within compliance
and that
leachate
is
percolating
down
through
the waste
as
a
delayed
reaction
from the
preceding
rain
events.
Mr.
Curry
inquired
if the
south
sedimentation
pond should
be
tested. I
told
him
that I would
not direct
him to
do
so
at
this
time. I explained
to
him
that
I intended
to consult
Jeff
Turner
at
the Illinois
Environmental
Protection
Agency
(IEPA)
Regional
Office
regarding
the matter.
Mr.
Curry requested
that
I inform
him of the
outcome
of
my
intended
conversation
with Mr.
Turner.
Mr.
Curry
said
that if
the shut-off
valve
at the sedimentation
pond was
not
yet
turned off
it would be
closed.
He also stated,
“Rick is going
to address
the
cause of
the
problem
today.”

p.m.
on December

Jeff
Turner
at
the
IEPA
Regional
Office and
explained
my latest
observations
at VVLF.
Mr. Turner
indicated
that he
would
consult
with
others within
the IEPA.

VVLF

a 6,000 gallon
