    HEARING OFFICER ORDER
    On December 1, 2009, all parties participated in a telephonic status conference
    with the hearing officer. The petitioner represented that the parties continue with
    settlement discussions and that it has forwarded a draft permit application to the
    respondent for its review. The parties remain hopeful that a permit will be issued prior to
    the next telephonic status conference. By agreement, the administrative record is now
    due to be filed on or before January 22, 2010. The petitioner stated that it will file an
    additional waiver of the statutory decision deadline to and including April 2, 2010.
    The parties or their legal representatives are directed to participate in a telephonic
    status conference with the hearing officer on January 7, 2010, at 9:30 a.m. The
    telephonic status conference must be initiated by the petitioners, but each party is
    nonetheless responsible for its own appearance. At the status conference, the parties must
    be prepared to discuss the status of the above-captioned matter and their readiness for
    hearing. If, however, a motion to voluntarily dismiss is filed prior to the next status
    conference, the conference will be cancelled without further notice.
