HEARING REPORT
On October 28, 2009, a hearing in this matter was held C.E. Brehm Memorial Public
Library in Mt. Vernon, Illinois. Attorney Dale Guariglia appeared on behalf of the petitioner.
Attorney Charles Matoesian appeared on behalf of the Illinois Environmental Protection Agency.
Witness Credibility

Mr. Andrew Russo
Based upon my legal judgment, experience, and observations at hearing, I find that the credibility
of witness is not an issue in this matter.
Agency Responses and Briefing Schedule
The transcript is due by November 9, 2009, and the public comment deadline is
November 12, 2009. Because the Agency was unable to answer certain questions at hearing, it
was decided that written answers would be filed by November 16, 2009. Petitioner will file any
responses to the Agency’s answers in its post-hearing brief which shall be filed by December 7,
2009. Respondent’s post-hearing brief, if any, is also due by December 7, 2009.
