HEARING OFFICER ORDER
On October 29, 2009, a telephonic status conference was held. The respondent
did not appear. The petitioner stated that it appears the above-captioned appeal is settled
but that it is awaiting a revised operating permit from the respondent. The petitioner is
hopeful that the respondent will forward the permit in the near future.
The parties or their legal representatives are directed to participate in a telephonic
status conference with the hearing officer on December 21, 2009, at 10:00 a.m. The
telephonic status conference must be initiated by the petitioner, but each party is
nonetheless responsible for its own appearance. At the status conference, the parties must
be prepared to discuss the status of the above-captioned matter and their readiness for
hearing. If, however, a motion to voluntarily dismiss is filed prior to the next status
conference, the conference will be cancelled without further notice.
