    OFFICER ORDER
    On October 15, 2009, all
    parties participated in a telephonic
    status conference with the
    hearing officer. The
    parties represented that settlement
    discussions continue
    and that it appears
    all issues have been resolved. The respondent
    stated that it is preparing a draft for petitioner’s
    review. To that end, the record and respondent’s
    answer are now due
    to
    be filed on
    or before
    December 31, 2009. The petitioner represented
    that it will file
    an additional 90 day waiver of
    the
    statutory decision deadline.
    The parties or their legal representatives
    are directed to participate
    in a telephonic status
    conference
    with the
    hearing officer on December 10, 2009,
    at 11:00 a.m. The telephonic status
    conference must be initiated by the petitioners,
    but
    each party is nonetheless responsible for
    its
    own appearance. At the status conference, the
    parties
    must be prepared to discuss the
    status
    of
    the above-captioned matter and their readiness
    for hearing.
