HEARING OFFICER ORDER
On September 24, 2009, all parties participated in a telephonic status conference
with the hearing officer. The parties represented that they intend to file a joint motion to
voluntarily dismiss the above-captioned matter. The parties represented that they have
agreed to settlement terms and plan to incorporate them into the motion. The parties were
advised to consider Section 103.301 of the Board’s procedural rules prior to filing.
