AGREED
MOTION FOR EXTENSION OF TIME
Pursuant to 35 Ill. Adm. Code 101.522, Trinity Rail Group, Inc. ("Trinity")
submits this Agreed Motion for Extension of Time to Answer or Otherwise Plead to the
Complaint. In support
of its Motion, Trinity states as follows:
1.
The Attorney General, on behalf of the People of the State of Illinois ("People"),
served the Complaint on Trinity's representative on or about August 3,2009.
2.
Under the Illinois Pollution Control Board's rules, absent an extension, Trinity
would need to respond to the Complaint by
October 2,2009. However, certain documents are
being provided by the Attorney General which may affect the nature
of Trinity's response to the
Complaint.

Accordingly, Counsel for Trinity contacted the Attorney General and requested an
extension of time to answer or otherwise plead to the Complaint. The Attorney General's Office
agreed to an extension until November 20, 2009.
WHEREFORE, Trinity respectfully requests that the Hearing Officer grant this Agreed
Motion for Extension of Time to Answer or Otherwise Plead and extend Trinity's response date
until November 20, 2009.
