ORDER OF THE BOARD (by S.D. Lin):
On September 2, 2009, ConocoPhillips Company (ConocoPhillips) filed a motion for
voluntary dismissal of this underground storage tank (UST) appeal (Mot.). The appeal concerns
ConocoPhillips’ leaking UST site located at 524 Old York Road in Elmhurst, DuPage County.
ConocoPhillips petitioned the Board for review of a July 26, 2006 determination of Illinois
Environmental Protection Agency (Agency) in which the Agency rejected ConocoPhillips’
proposed corrective action plan budget.
In the pending motion for voluntary dismissal, ConocoPhillips represents that it and the
Agency have “reached a settlement agreement that fully and completely resolves all of the issues
in dispute between the parties with respect to the instant appeal.” Mot. at 1. ConocoPhillips
therefore requests that the Board dismiss this case.

. The Board grants the motion, dismisses
the appeal, and closes the docket.
