On September 16, 2009, petitioner filed a motion for extension of time to file a
response to the Agency’s recommendation. Petitioner seeks permission to file its
response by
September 30, 2009, and has waived the decision deadline to January 7, 2010. According
to petitioner, respondent does not object. The motion is granted, and petitioner’s
response is due by September 30, 2009.
