    HEARING
    OFFICER ORDER
    On September 10, 2009, all
    parties participated in a telephonic status conference
    with the
    hearing officer. Complainant
    reported that its consultants have forwarded its
    report to the
    Metropolitan Reclamation
    District for its review. Matters are
    proceeding, albeit a little behind
    schedule.
    The Village of Hinsdale represents
    that construction is underway for the flow facility,
    including construction of the underground
    tank. Due to a number of issues, the construction
    is
    running behind schedule but it is anticipated
    that
    it will be completed by October 2009. The
    Village also represents that they continue
    to await a draft NPDES permit from the Illinois
    Environmental Protection Agency.
    The
    parties or their legal representatives are
    directed to
    participate
    in a telephonic status
    conference with the hearing
    officer on November 18, 2009,
    at
    11:00
    a.m. The telephonic status
    conference must be initiated
    by
    the complainant, but each party is nonetheless
    responsible
    for its
    own appearance. The complainant
    represented that it will
    notifi
    the parties and
    the hearing
    officer of a call-in number prior
    to the next telephonic status conference. At the
    status
    conference, the parties must be
    prepared to discuss the status of the above-captioned matter
    and
    their readiness for hearing.
