HEARING OFFICER ORDER
On August 26, 2009, all parties participated in a telephonic status conference.
The parties represented that they are awaiting the Board’s ruling regarding respondent’s
affirmative defenses plead in its answer. The affirmative defenses have been fully briefed
as of August 25, 2009, pursuant to the August 6, 2009, Board order.
The parties or their legal representatives are directed to appear at a telephonic
status conference with the hearing officer on October 8, 2009, at 11:30 a.m. The
telephonic conference must be initiated by the complainants, but each party is nonetheless
responsible for its own appearance. The call-in telephone number supplied by the
complainants will be the same as the August 26, 2009, call-in number. At the conference
the parties must be prepared to discuss the status of the above-captioned matter and their
readiness for hearing.
