ORDER OF THE BOARD (by G.T. Girard):
On May 21, 2009, at the parties’ request, the Board extended until August 6, 2009, the
time period for BP Products North America, Inc. – Main Plant (Log. No. B-147-CA-71)
(petitioner) to appeal a March 31, 2009, determination of the Illinois Environmental Protection
Agency (Agency).

415 ILCS 5/40(a)(1) (2006); 35 Ill. Adm. Code 105.406. The
determination concerns a former BP Refinery in Wood River, Illinois. The Agency’s decision
concerns corrective action for the site. Because petitioner failed to timely file an appeal, the
Board dismisses this case and closes the docket.
