HEARING OFFICER ORDER
On August 17, 2009, the parties participated in a telephone status conference with
the hearing officer. The related trial in circuit court was decided in favor of the
respondents. According to complainant’s attorney, the circuit court and Pollution Control
Board cases are not identical with respect to the issue of relief, and complainants have not
yet decided whether to proceed with the case before the Board.
The parties are directed to participate in a telephone status conference with the
hearing officer at 9:00 a.m. on August 31, 2009. The status conference shall be initiated
by the complainants.
